Welcome to Vertinel. These Terms of Service ("Terms") govern your use of our website and services, including our Discord Notification Platform and consulting services. By accessing or using Vertinel's services, you agree to be bound by these Terms.

1. Services

Vertinel provides two categories of services:

  • Consulting Services: ERP implementation (ERPNext), CRM setup, workflow automation (n8n), and related digital transformation engagements. These are governed by separate service agreements entered into with each client.
  • Discord Notification Platform: A self-serve SaaS product that allows developers and businesses to send real-time Discord notifications via our REST API. Access is granted upon payment of the applicable one-time fee.

2. Account Registration

To access the Discord Notification Platform, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Payment and Refunds

The Discord Notification Platform is offered as a one-time lifetime purchase. Payments are processed securely through our payment provider. Due to the digital nature of the service, all sales are final unless otherwise required by applicable law.

Consulting service fees are defined in individual project agreements and are subject to the payment terms stated therein.

4. Acceptable Use

You agree not to use Vertinel's services to:

  • Violate any applicable laws or regulations
  • Transmit spam, malware, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Resell or redistribute access to the platform without authorization
  • Engage in any activity that disrupts or interferes with the service

5. API Usage

Your API key is personal and non-transferable. You are responsible for all API requests made using your key. We reserve the right to throttle or suspend access if usage is deemed abusive or in violation of these Terms.

6. Intellectual Property

All content, trademarks, and software related to Vertinel are the property of Vertinel or its licensors. You may not copy, modify, or distribute our content without express written permission.

7. Limitation of Liability

To the maximum extent permitted by law, Vertinel shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services. Our total liability shall not exceed the amount paid by you for the applicable service in the preceding three months.

8. Service Availability

We strive to maintain high availability of our platform but do not guarantee uninterrupted service. Scheduled and emergency maintenance may cause temporary downtime. We will communicate planned outages where possible.

9. Termination

We reserve the right to suspend or terminate your access to our services at any time for violations of these Terms. You may also close your account at any time by contacting us.

10. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email.
